Terms of Use
These Terms of Use govern your access to and use of PharmaFly, including the PharmaFly mobile application, website, account features, subscriptions, and related services (together, the “Service”). In these Terms, “PharmaFly”, “we”, “our”, and “us” means the operator of PharmaFly.
By downloading, installing, accessing, or using the Service, creating an account, or purchasing a subscription, you agree to these Terms.
If you do not agree to these Terms, you must not use the Service.
1. Acceptance of Terms
These Terms form a legally binding agreement between you and PharmaFly when you access or use the Service.
2. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Service, applicable law, security requirements, payment or platform rules, or our operational practices.
Where changes are material, we will take reasonable steps to notify you, such as by updating the mobile application or website, sending an email, or providing an in-app notice before or when the changes take effect.
Your continued use of the Service after updated Terms take effect means you accept the updated Terms. If you do not agree, you should stop using the Service and, if applicable, cancel any subscription through the platform where you purchased it.
Nothing in these Terms affects any legal rights or remedies that you already have under applicable law.
3. Licence to Use the Service
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own educational revision purposes.
The PharmaFly mobile application is licensed, not sold, to you. All rights not expressly granted in these Terms are reserved by PharmaFly and its licensors.
This licence does not allow you to:
- Resell, rent, sub-license, or commercially exploit the Service or its content
- Share your account or paid access with unauthorised users
- Copy, reproduce, distribute, republish, scrape, or extract materials contained within the Service
- Modify, reverse engineer, decompile, or attempt to derive source code from the Service, except where applicable law allows this
4. User Accounts
You may need to create an account to use parts of the Service, including profile features, free-plan access, subscriptions, account recovery, and cross-platform access.
You agree to provide accurate, current, and complete account and profile information, including your name, email address, and exam date where requested.
You are responsible for keeping your login credentials secure and for activity that occurs through your account, except where that activity results from our failure to use reasonable care.
You must contact us promptly if you believe your account has been accessed without authorisation.
We may suspend or disable your account where reasonably necessary, including if we believe you have materially breached these Terms, misused the Service, created a security risk, or used the Service in a way that may harm PharmaFly, other users, or third parties.
5. Subscriptions and Payments
PharmaFly may offer free features and paid subscription features. Subscription plans, billing periods, prices, renewal terms, and included benefits are shown at the point of purchase before you confirm payment.
Payments may be processed by the Apple App Store, Google Play, RevenueCat Web Billing, or another authorised payment provider. Your purchase is also subject to the terms, billing rules, cancellation process, and refund policy of the platform or provider through which you purchased.
Auto-renewing subscriptions renew automatically unless cancelled before the renewal date in accordance with the rules of the platform or provider where the subscription was purchased.
You are responsible for managing and cancelling your subscription through the platform or provider where you purchased it. Deleting your PharmaFly account or uninstalling the mobile application does not automatically cancel an active subscription.
Refunds are handled by the platform or payment provider that processed the purchase, except where PharmaFly is legally required to provide a remedy directly.
Subscription access may take a short time to update after purchase, cancellation, renewal, refund, billing failure, or restoration while the relevant provider confirms your entitlement.
6. Intellectual Property
The Service and its content, including question banks, explanations, text, graphics, logos, interface design, software, databases, and other materials, are owned by PharmaFly or licensed to us and are protected by copyright, trade mark, database right, and other intellectual property laws.
You may use the Service and its content only as allowed by these Terms and for your own educational revision purposes. You do not acquire ownership of any intellectual property rights in the Service or its content.
You must not copy, reproduce, distribute, publish, sell, share, scrape, upload, transmit, adapt, or otherwise exploit the Service or its content outside the normal functionality of the Service, except with our prior written permission or where applicable law expressly allows it.
This includes redistributing, screenshotting for distribution, compiling, or reproducing PharmaFly question banks, explanations, or educational materials outside the Service.
7. Feedback and User Submissions
PharmaFly does not currently provide public posting, messaging, or user-generated content features.
If you send us feedback, suggestions, support requests, corrections, or other communications about the Service, you are responsible for making sure you have the right to share that information with us.
You allow us to use those submissions as reasonably necessary to respond to you, provide support, investigate issues, maintain the Service, and improve PharmaFly. We will handle personal information in accordance with our Privacy Policy.
Please do not submit material that is unlawful, confidential to someone else, infringes third-party rights, or contains special category personal data or criminal offence data.
8. Prohibited Conduct
You agree not to use the Service in any manner that:
- Violates any applicable law or regulation
- Infringes the rights of PharmaFly, other users, or third parties, including intellectual property and privacy rights
- Attempts to gain unauthorised access to the Service, user accounts, payment systems, subscriptions, or connected systems
- Interferes with, disrupts, overloads, damages, or impairs the Service or its security
- Uses bots, scraping tools, automated scripts, bulk extraction, or similar methods to access, copy, or extract questions, explanations, data, or other content
- Attempts to bypass free-plan limits, subscription checks, entitlement systems, access controls, or security measures
- Introduces viruses, malware, harmful code, or other malicious material
- Shares, sells, transfers, or otherwise allows another person to use your account, login credentials, or paid access
- Uses the Service to submit unlawful, abusive, misleading, infringing, confidential, or harmful material
9. Educational Disclaimer
PharmaFly is an educational revision tool for individuals preparing for pharmacy-related assessments, including professional pharmacy examinations.
PharmaFly is not an official resource of the General Pharmaceutical Council, the Pharmaceutical Society of Northern Ireland, or any examination provider, and it is not endorsed by them.
We do not guarantee that using PharmaFly will result in exam success, registration, qualification, employment, or any particular outcome.
Content in the Service may contain errors, omissions, or become outdated. You remain responsible for checking official sources, current clinical and regulatory guidance, and applying your own professional judgement.
PharmaFly does not provide medical, clinical, legal, regulatory, or professional advice and must not be used as a substitute for advice from qualified professionals or for decisions involving patient care.
10. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis, subject to any rights you have under applicable consumer law.
We use reasonable care and skill in operating the Service, but we do not guarantee that the Service will always be uninterrupted, error-free, secure, or available at all times.
We do not guarantee that all content will always be accurate, complete, current, or suitable for your particular circumstances.
Nothing in these Terms excludes or limits any rights you have under applicable law that cannot legally be excluded or limited.
11. Limitation of Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any rights you have under applicable consumer law.
PharmaFly is not responsible for losses that were not caused by our breach of these Terms, losses that were not reasonably foreseeable when you agreed to these Terms, or losses arising from your misuse of the Service or failure to follow these Terms.
The Service is provided for personal educational revision use only. We are not responsible for business losses, loss of profit, loss of revenue, loss of goodwill, or loss of business opportunity.
Where we are legally responsible for loss or damage, our responsibility will be limited to what is fair and reasonable in the circumstances and permitted by applicable law.
12. Responsibility for Misuse
You are responsible for losses that PharmaFly reasonably suffers as a direct result of your material breach of these Terms, misuse of the Service, infringement of intellectual property rights, unauthorised sharing of paid access, or unlawful conduct.
We will not seek to recover losses from you where the loss was caused by our own breach of these Terms, our failure to use reasonable care, or matters outside your reasonable control.
13. Termination
You may stop using the Service at any time. You may also request account deletion using the account deletion features or contact details we provide.
We may restrict, suspend, or terminate your access to the Service where reasonably necessary, including if you materially breach these Terms, misuse the Service, create a security risk, infringe intellectual property rights, share paid access without authorisation, or use the Service unlawfully.
Where practical and appropriate, we will give notice or an opportunity to resolve the issue before restricting, suspending, or terminating access. We may act without prior notice where urgent action is reasonably necessary to protect the Service, users, third parties, or PharmaFly.
If your access is terminated, your right to use the Service will cease. Any terms that by their nature should continue after termination will continue, including intellectual property, payment, responsibility for misuse, liability, governing law, and dispute provisions.
Deleting your PharmaFly account or stopping use of the Service does not automatically cancel an active subscription. You remain responsible for cancelling subscriptions through the platform or provider where you purchased them.
14. Governing Law
These Terms are governed by the laws of England and Wales, except where the laws of another part of the United Kingdom must apply because of your place of residence or applicable consumer protection law.
15. Dispute Resolution
If a dispute arises, we encourage you to contact us first so we can try to resolve it informally.
If a dispute cannot be resolved informally, you may bring legal proceedings in the courts of England and Wales, or in the courts of Scotland or Northern Ireland if you live there and applicable law gives you that right.
16. Severability
If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part will be treated as removed or limited to the minimum extent necessary. The remaining parts of these Terms will continue to apply where they can operate fairly and lawfully without the removed or limited part.
17. Entire Agreement
These Terms, together with the PharmaFly Privacy Policy and any subscription or purchase terms shown to you at the point of purchase, set out the main terms that apply between you and PharmaFly for your use of the Service.
Platform or payment provider terms may also apply to purchases, billing, cancellation, refunds, and subscription management. Nothing in these Terms limits any rights you have under applicable law.
